1. Cooling Off
1.1 If the Tenant cancels their application for accommodation before entering into the Tenancy or fails to enter into the Tenancy within seven (7) calendar days of the offer of accommodation being issued by IIL2 Ltd (the “Deadline for Agreement”), IIL2Ltd will provide a full refund of the Holding Deposit.
1.2 If the Tenant, having entered into the Tenancy, cancels their Tenancy within seven (7) calendar days of having entered into it, IIL2 Ltd will provide a full refund of the Holding Deposit.
1.3 The Tenant can cancel their accommodation booking under Clauses 1.1 and 1.2 above by sending an email to contact@stgeorgestower.com. The Tenant’s Holding Deposit will be refunded within seven (7) calendar days of the Tenant’s cancellation or of the Deadline for Agreement as applicable.
1.4 If the Tenant wishes to cancel their Tenancy after signing this Agreement, Clause 2 below will apply.
1.5 Any refunds must be requested by the Tenant in writing and can only be considered Monday to Friday (save for Bank Holidays) between the hours of 08:00 and 16:00 by the Landlord.
2. Cancellation by the Tenant
2.1 Subject to Clause 1.2 above and Clause 2.2 below, after signing this Agreement the Tenant will remain liable for the Total Rent for the full term of the Tenancy and their guarantor, if reasonable, will be required to meet the obligations set out within their Tenancy.
2.2 The Tenant may only terminate their Tenancy in the following circumstances and will remain responsible for payment of the Total Rent until:
- a) they have given three (3) months’ written notice to the Landlord; and
- b) either:
- they have made any outstanding payments or fulfilled any obligations required under their Tenancy, including the payment of the Total Rent for the full term of the Tenancy, to the Landlord’s reasonable satisfaction; or
- a replacement student at the University/College who is reasonably satisfactory to the Landlord as a tenant and who is not already a tenant at the Site enters into a tenancy agreement with the Landlord. IIL2 Ltd subject to Clause 2.3 below, may assist the Tenant in finding a replacement, but does not guarantee that it will be able to find one.
2.3 IIL2 Ltd shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Tenant’s vacated accommodation under Clause 2.2(b)(ii) above.
2.4 COVID-19 Cancellation Policy: The UK government has advised that tenancy agreements remain unaffected by the COVID-19 measures introduced. Therefore, all tenancy agreements are still enforceable, and rent is due as per the terms of this agreement.
2.5 If you secure your accommodation and then Government imposed travel restrictions prevent you from travelling to the UK to take up your place at university, official written evidence from the University confirming that you have cancelled your studies and will not be enrolled as a student at the University for the forthcoming academic year must be sent to contact@stgeorgestower.com before the tenancy start date. If satisfactory evidence is provided, you will be eligible for release from the tenancy agreement.
Alternatively, you may request that the start of your tenancy be put back to the first day of the month on which the restrictions are lifted and you are able to travel to the UK. Please submit your request to contact@stgeorgestower.com before the original tenancy start date. If sufficient evidence is provided, we will change your tenancy start date to the first day of the month on which the travel restrictions are lifted. We will send you written confirmation of your new tenancy start date. We will also apply a credit to your account for the accommodation fees for the period from your original tenancy start date to the new tenancy start date.
